These terms are the agreement between you and Rackvolt Cloud Solutions Private Limited ("Ekire", "we", "us") for the use of Ekire: our cloud servers, add-ons, the console at app.ekire.cloud, the API, and this website. You agree to them when you create an account or run a server. If you are using Ekire for a company, you are agreeing on that company's behalf.
Your account
You need an account to run anything on Ekire. Keep your details accurate. Keep your login credentials private. You are responsible for everything done under your account, including what your team members do and what your API keys do.
- You must be at least 18 and able to enter a contract.
- One person or company per account, unless we agree otherwise in writing.
- You are responsible for the data you store and the software you run. That includes keeping your own backups of anything you care about.
- Tell us promptly if you believe someone else has access to your account.
Acceptable use
Our Acceptable Use Policy lists what you may not run on Ekire. It is part of these terms. If you break it, we can suspend or remove the server involved. In serious cases we can close your account.
You also agree to follow the laws that apply to you, and not to use Ekire to help anyone else break these terms or the AUP.
Billing and your wallet
Ekire runs on a prepaid wallet. You add funds. The cost of what you run is drawn from that balance.
- Hourly, capped at the monthly price. Every plan has a monthly price. The hourly rate is that monthly price divided by 730. It is capped: however many hours you run in a month, a server never costs more than its monthly price.
- A server bills until you destroy it. Stopping a server does not stop its billing. A stopped server keeps drawing from your wallet at its normal rate. Destroying the server stops the billing that hour. There is no setup fee and no contract. You cancel by destroying what you are running.
- Add-ons bill for as long as they exist. Block storage and reserved IPs bill while they are on your account, including while they are detached from any server. Snapshots bill every month you keep them. Deleting them is what stops the charge.
- Add-on rates. Block storage, reserved IPs, snapshots beyond the free three, backups, and bandwidth over your plan's allowance are drawn from your wallet at the rates on our pricing page.
- No refunds for time already used. Wallet funds pay for resources as you run them, so we do not refund hours you have already used. Our Refund & Cancellation Policy covers what happens to unspent balance, cancellations and chargebacks. For a question about a specific charge, email [email protected].
- Prices are in US dollars. They do not include taxes that may apply where you are; those are your responsibility.
When your wallet runs empty
Servers keep running as long as your wallet can pay for them. This is what happens when the balance runs out.
- We notify you as your balance gets low, so you have time to top up.
- If the wallet empties, your servers may be suspended: powered off, but kept in place, for a grace period.
- Add funds during the grace period and you can power everything back on where it was.
- If the grace period passes with no funds added, we may reclaim the server and its local storage to free up capacity. A reclaimed server's data is gone and cannot be recovered. Keep your own backups of anything important.
The grace-period length is shown in your console. It may change over time.
Ending the agreement
You can stop using Ekire at any time. Destroy your servers and, if you want, close your account. Any remaining wallet balance is handled as described in our Refund & Cancellation Policy.
We can suspend or close your account if you break these terms or the AUP, if we are required to by law, or if your use puts our platform or other customers at risk. Where it is reasonable, we will give you notice and a chance to fix the problem first. In cases of attack traffic, illegal content or fraud, we may act immediately.
Service, warranties, and our limits
Our uptime commitment is in the SLA. This section covers the legal limits on what we promise.
- Ekire is provided "as is." Beyond what the SLA and the law require, we do not promise the service will be uninterrupted, error-free, or fit for a particular purpose you have in mind.
- You are responsible for your own data and backups. We provide snapshots and backups as tools. The decision to use them, and to keep copies elsewhere, is yours.
- To the extent the law allows, we are not liable for indirect or consequential losses, including lost profits, lost data and business interruption, and our total liability to you for any claim is limited to the amount you paid us for the service in the [three] months before the claim.
Some places do not allow certain limits, so parts of this section may not apply to you. Nothing here is meant to take away rights you have that cannot be waived.
Changes to these terms
We may update these terms as Ekire changes or the law changes. When we make a meaningful change, we will update the date above and tell you through the console or by email before it takes effect. Using Ekire after a change takes effect means you accept the new terms. If you do not agree, you can stop using Ekire and close your account.
The legal basics
These terms, the AUP, the SLA, the Refund & Cancellation Policy, and our Privacy Policy together make up the whole agreement between us. They are governed by the laws of India, and disputes will be handled there. If one part is found unenforceable, the rest still stands. If we do not act on a breach right away, we do not lose the right to act later.
